The Shevchenkivskyi District Court of the city of Zaporozhye found the driver of an electric scooter guilty for hitting a pedestrian.
According to the court’s verdict, in June 2020, the driver of the Xiaomi Mi Electiric Scooter M365 electric scooter, moving along the sidewalk, hit a pedestrian. As a result of the collision, the victim received moderate bodily injuries.
Considering the case, the court recognized that the electric scooter, as a device designed to transport people and (or) cargo, as well as special equipment or mechanisms installed on it, is a vehicle. And according to clause 11.13 of the Traffic Regulations, the movement of vehicles on sidewalks and pedestrian paths is prohibited.
As a result, the court found the scooter driver guilty of violating the rules in force on transport (Article 291 of the Criminal Code of Ukraine). He was sentenced to imprisonment, released from serving him with a probationary period of 1 year.
In addition, the court partially satisfied the civil claim and recovered from the accused:
- 102 thousand hryvnia of material damage
- 23 thousand hryvnia for moral damage
- 2 thousand hryvnia expenses for legal assistance
As previously reported, the Verkhovna Rada has registered two bills designed to regulate the movement of electric scooters, segways, segues and hoverboards. If they are accepted, the drivers of such vehicles will become road users with the same rights as the drivers of bicycles and horse-drawn vehicles. Fines for traffic violations will be from UAH 340.
